Parties In these conditions TFB Storage Solutions Limited is called "the Company" and any individual, firm, company or other party with whom the Company contracts is called "the Customer". 2. Quotations Any quotation given by the company is not a binding contract unless it is accepted by the company in writing with an authorised signature. All the conditions of this contract shall be contained within the quotation and are active once the quotation is accepted by both parties. 3. Prices Unless the price is listed differently on the quotation it will be accepted as the price listed on this website. All orders of value under £250 excluding VAT are subject to a £10 low order fee. 4. Returns and custom goods No returns will be accepted and all goods sold are non-refundable. In the case of non delivery we must be informed within 24 hours after the expected delivery time, in order to make a claim if the goods have been lost. However, even if this is the case there is no guarantee that replacement goods can be re-sent. 5. Despatch Whilst the company will make every effort to ensure that the listed delivery times are met, these are not binding by the company. If the company fails to deliver the goods within this time period it will nopt constitute a breach of contract. 6. Delivery Unless otherwise specified in the contract, delivery shall be to the customers premises and any unloading shall be at the customers expense and risk. 8. Liability 9. Indemnity The Customer will indemnify the Company against any claim made against the Company in respect of injury to any person or damage to any property arising from any defect in the goods or anything done or omitted to be done in the delivery thereof to the Customer where such delivery is effected by the Company, including any such injury or damage caused by the negligence of the Company, its employees or agents. 10. Title (a) Notwithstanding that the risk in the goods has passed to the Customer, ownership thereof shall not pass to the Customer unless and until all money owing to the Company by the Customer has been paid. If the Customer incorporates the goods in another object or objects the ownership of such object or objects shall vest in the Company immediately such incorporation takes place as security for payment of all such money as aforesaid. (b) Notwithstanding the provisions of paragraph (a) of this Condition the Customer may sell such goods or the object or objects in which they have been incorporated in the ordinary course of trading provided always that whilst any money remains owing by the Customer to the Company the Customer will, if requested by the Company, assign to the Company free from all charges and incumbrances all claims the Company may have against the persons to whom such goods or objects have been sold for the purchase price payable to the Customer in respect thereof. (c) The Customer hereby grants to the Company an irrevocable license to enter at any time any premises owned or occupied by the Customer for the purpose of repossessing and removing any such goods or objects as aforesaid the ownership of which has remained or has become vested in the Company under paragraph (b) of this Condition and the Company shall not be responsible for (and the Customer will indemnify the Company against all liability in respect of) damage caused to such premises in such repossession and removal being damaged it was not reasonably practicable to avoid. 12. Specification and quantities All weights and dimensions are approximate only and are therefore not guaranteed by the company. 13. Packing cases Unless otherwise provided in the Contract, the price does not include the cost of cases or other packing material.
